Constitution and rules

Rule one - name and registered address of NAHT Edge

1. The name of the organisation formed under these rules shall be known as NAHT Edge. The registered office and head office of NAHT Edge shall be at NAHT's HQ or at such other place as the NAHT Edge Management Board shall decide

 

Rule two - objects and purposes of NAHT Edge

2. The objects and purposes of NAHT Edge shall be as follows:

  • To promote and advance the status of middle leaders in education by developing their skills and acting effectively on educational issues
  • To support all members by providing the following:
a) information and guidance about performing their duties successfully through both experts and peer-to-peer networks;
b) assistance in developing their professional skills by providing relevant continuing professional development (CPD), career development, and shadowing, mentoring and secondment opportunities; and
c) services, benefits, representation and legal assistance as defined in NAHT’s constitution and rules.

  • To uphold the highest possible standards of professional conduct among members of NAHT Edge
  • To provide a clear, reasoned and effective voice for middle leaders in the education debate
  • To promote and further the cause of education generally, contributing to the achievement of the highest standards of teaching, learning and leadership in all educational establishments and for all children
  • To promote equality of opportunity and treatment at work irrespective of age, gender, ethnicity, disability, sexual orientation, faith or belief, and any relevant protected characteristics in line with legislation

 

Rule three - NAHT Edge membership

3. To join, members will need to meet one of the following criteria:

  • Lead a subject or curriculum area across the school or department
  • Be accountable for pupil development or progress across the school, year or department
  • Develop the teaching practice of other staff
  • Line manage other staff, or be accountable for staff members’ performance

3.1 This must be demonstrated by one of the following:

  • Pay scale or responsibility allowance eg teaching and learning responsibility levels one to three or leading practitioner status
  • Job title eg assistant head teacher, head of year, head of subject, head of department, special educational needs coordinator, etc
  • Supporting evidence eg job description or narrative

3.2 Notes

  • Salary scales and job roles may vary in some schools (eg academies and free schools). However, the equivalents or previous iterations are accepted
  • Teachers with salaries on the main pay range (MPR) and upper pay scale (UPS) need to have an appropriate job title and responsibilities
  • Assistant head teachers can choose between NAHT and NAHT Edge
  • Head teachers and deputy head teachers on the leadership pay spine are only eligible for NAHT membership
  • Members must meet at least one of the above eligibility criteria as well as agree to our constitution, and terms and conditions

3.3 Membership of NAHT Edge is largely self-selecting with the online joining process requiring members to agree they fulfil the above criteria. The NAHT Edge Management Board reserves the right to withhold or withdraw membership from an individual

3.4 Eligibility and annual subscriptions can be reviewed as required by the NAHT Edge Management Board

 

Rule four - rights of NAHT Edge members

4. The NAHT Edge Management Board shall determine the rights of members and the range and extent of NAHT Edge's services and benefits, subject to approval by NAHT National Executive

4.1 Full members shall be entitled to the following:

a) the right to stand for election to the NAHT Edge Advisory Council;

b) the right to vote in elections for the NAHT Edge Advisory Council; and

c) the right to vote in General Secretary elections.

4.2 Full members shall be entitled to legal advice and, where appropriate, representation at any court, tribunal, or other quasi-judicial or administrative body, subject to the following qualifications:

a) Members will not be eligible for assistance in connection with any issue that arose either before they joined NAHT Edge or during a gap where they were not in membership

b) All legal assistance from NAHT Edge shall be at the discretion of the NAHT Edge Management Board, who will have regard to the advice of their solicitors and counsel before deciding on each application arising

This legal advice shall be provided to NAHT Edge members by NAHT.

4.3 The NAHT Edge Management Board will determine other rights and benefits for the members of NAHT Edge which will include but will not necessarily be limited to the following:

a) information and guidance in carrying out their duties through both experts and peer-to-peer networks;

b) assistance in developing their professional skills by providing relevant CPD, career development, and shadowing, mentoring and secondment opportunities;

c) advice, help and, where appropriate, representation concerning any enquiries on pay, terms and conditions of service, pensions (eg Teachers’ Pension Scheme and Local Government Pension Scheme), educational policy issues or any other professional matter; and

d) copies of NAHT Edge's professional bulletins, advice documents and full access to electronic communications used by NAHT Edge.

 

Rule five - obligations of NAHT Edge membership

5. Members of NAHT Edge shall pay an annual subscription determined by the NAHT Edge Management Board

5.1 Subscriptions for members of NAHT Edge are due on a rolling monthly basis and shall be payable in entirety or via periodic Direct Debit payments as agreed by the NAHT Edge Management Board. It's the responsibility of the member to notify NAHT Edge of any changes of circumstance

5.2 Full members who are more than three calendar months in arrears with their subscription payments shall be deemed to have resigned their membership and shall not be entitled to any of NAHT Edge's services or benefits following this period of non-payment

5.3 All NAHT Edge members are expected to protect and promote the reputation of NAHT Edge as an accepted authority on education. On occasion, the NAHT Edge Management Board shall have the power to proceed against any member who may be in breach of these rules and who, by their actions, may be deemed to have brought discredit upon NAHT Edge and/or NAHT. Such proceedings may be instituted against either an individual or a representative of NAHT Edge and/or NAHT, particularly, but not exclusively, through any breach of rule two

5.4 Should any member or non-member who is an employee of the NAHT be deemed by the NAHT Edge Management Board to warrant having proceedings taken against them, they shall be proceeded against in the first instance on the basis that their behaviour was in breach of their contract of employment

5.5 Any complaint under sub-rule 5.6 shall be made in the first instance to the Chief Executive of NAHT Edge by an individual member, a group of members, a National Officer of the NAHT, a member of the NAHT Edge Management Board or the National Executive itself

5.6 The procedures for hearing such complaints and any subsequent appeals against the decisions of the NAHT Edge Management Board shall be laid out in detail in NAHT's Appendix D and on the NAHT Edge website

5.7 The NAHT Edge Management Board shall, after following the hearing and appeals procedures outlined in NAHT's Appendix D, have the power to administer one or more of the following sanctions to member(s) held in breach of these rules:

a) Censure

b) Disqualification from holding office in NAHT Edge for a specified period

c) Suspension from membership for a specified period

d) Expulsion from NAHT Edge

5.8 If the Chief Executive of NAHT Edge, after consultation with the General Secretary, considers a complaint under these rules concerns any lay member who holds office within NAHT Edge, the Chief Executive shall have the power to suspend such a person pending the completion of the full procedure laid out in NAHT's Appendix D

 

Rule six  - NAHT Edge Management Board

6. The NAHT Edge Management Board will be the strategic decision-making body for NAHT Edge and will be responsible to NAHT for the day-to-day running of NAHT Edge

6.1 The NAHT Edge Management Board will consist of the following:

  • NAHT President;        
  • NAHT National Treasurer;
  • NAHT General Secretary;
  • Chief Executive of NAHT Edge;
  • one NAHT National Executive member chosen by National Executive; and
  • three members of the Advisory Council chosen by the members of the Advisory Council (see rule seven). 

 

Rule seven – NAHT Edge Advisory Council

7. The NAHT Edge Advisory Council shall consist of seven members of NAHT Edge plus the Chief Executive of NAHT Edge

7.1 Members of the Advisory Council, other than the Chief Executive, shall be elected by online ballot. The term of office for Advisory Council members shall be two years

7.2 Those candidates who wish to stand for election shall be invited to submit an electoral address of no more than 300 words to accompany the ballot paper

7.3 All elections for the Advisory Council shall be held online

7.4 In the event that members of the Advisory Council cease to be members of NAHT Edge, they shall resign their membership of the Advisory Council

7.5 In the event that a member of the Advisory Council ceases to be an NAHT Edge member or resigns from the Advisory Council, a by-election shall be held unless the vacancy occurs with less than four months outstanding on the term of office concerned

7.6 The NAHT Edge Advisory Council will only exist with more than 250 members in membership

 

Rule eight – Chief Executive of NAHT Edge: powers and responsibilities

8. The Chief Executive shall be responsible to the General Secretary of NAHT and shall act under their strategic direction

8.1 The Chief Executive shall, on behalf of the General Secretary, prepare a report on the work of NAHT Edge for the NAHT’s AGM

 

Rule nine – the funds of NAHT Edge

9. The funds of NAHT Edge shall be controlled under the provisions of rule 12 of the NAHT's constitution and rules

 

Rule 10 – interpretation of these rules

10. The interpretation of any matter arising from these rules shall be determined by the NAHT Edge Management Board in a manner consistent with the operation of NAHT’s constitution and rules

 

Rule 11 – amendment and revision of these rules

11. These rules can be amended by a decision of the NAHT Edge Management Board, endorsed by the National Executive of NAHT, or as a consequence of a rule change to the NAHT constitution and rules made under the provisions of rule 16 of NAHT’s constitution and rules
